You can't just rewrite the government because you're in the minority. And if you can, then why can't the GOP do it when they too invariably one day recede into minority? It undermines the legitimacy and credibility of the entire institution.This is a good point, but it also may signify that the Supreme Court has lost its way as a judicial branch of government, and has become, quite nakedly, an unelected legislative body, unable to be meaningfully checked by the other two branches.
It seems to me that the United States government, as conceived in 1789, is beginning to fall apart at the seams, and the time is approaching where we, as a country, will have to decide to draft a new Constitution.
