Nintendo might try to find something, as unlikely as actually finding any such grounds may be... somebody releasing a PS3 game that uses the Wiimote? I don't think Nintendo would just ignore that... :)

Nintendo would be a fool to attempt to legally strike out when it has no case. Sure big companies can pretty much shut down a little guy by suing them so often they run out of money for a defense, but this is MS and Sony we're talking about here, that isn't going to happen.
