Well clearly it would be limited in when it's used.
First point, well there's plenty of games that require seperate controllers to work. Rock Band, for example. Not EVERY game needs extra controls. You don't say "we have this guitar controller so let's make everyone support it". No, it would be an option so that developers who have good ideas for it COULD use it. Bam, two down and I'm not even breaking a sweat. As for lawsuits, let me ask you something. What possible ground could Nintendo stand on? People make custom drivers for things all the time, sometimes at a loss to the company. Nintendo would be a fool to attempt to legally strike out when it has no case. Sure big companies can pretty much shut down a little guy by suing them so often they run out of money for a defense, but this is MS and Sony we're talking about here, that isn't going to happen.
