I'm sure it'll be thrown out on the face of it. The robber has the right, but of course if this becomes a common pattern of abusing the legal system, he can have the right to sue for this removed, surgically.

I'll add that such a citizen's arrest could have gone badly. There's a small jump from citizen's arrest to vigilante justice. I don't think they made that jump in this case, but it's worth considering.
