The people down there seem to get it. Although, I worry that both sides of the spectrum will abuse this by using their own interpretations of the Constitution for their own pleasure. What do you all think? Arizona Congressmen have brains - Dark Jaguar - 11th August 2010 Wow, the immigration bill was too easy to abuse and violated people's freedom to NOT be randomly accused of being an illegal alien (seriously, would EVERYONE be expected to carry proof of citizenship? What of innocent until proven guilty?), but this really does seem reasonable. Yeah, I can support this. That is, for now, unless there's some potential violation of state's rights this may imply. That's absolute horse shit. The "General Welfare" clause does not give the government the power to provide Social Security. Liberals and Progressives have been misinterpreting that clause for years. Any constitutional lawyer and scholar can tell you that the "General Welfare" clause was not meant to be used as a weapon to give the government unlimited powers. In fact, the reason the tenth and States rights were created was because founders like Patrick Henry were worried that elements of the Constitution like the "General Welfare" clause would lead the government to believe that it could do whatever it liked. Thomas Jefferson on the meaning of general welfare: "[O]ur tenet ever was, and, indeed, it is almost the only landmark which now divides the federalists from the republicans, that Congress has not unlimited powers to provide for the general welfare, but were to those specifically enumerated; and that, as it was never meant they should raise money for purposes which the enumeration did not place under their action; consequently, that the specification of powers is a limitation of the purposes for which they may raise money." (Thomas Jefferson) "The Constitution’s “Commerce Clause” gives national leaders broad authority to regulate the national economy" The purpose of the "Commerce Clause" is to give the government the power to regulate the trade that occurs between states and other countries. Madison himself states in the Federalist Papers that the purpose of "commerce" was to refer only to trade. "The most famous example of tentherism is the ubiquitous frivolous lawsuits claiming that health reform is unconstitutional," "Frivolous", huh? Why doesn't he genius that wrote that article point out the part of the Constitution that gives the government the power to force me to buy healthcare or fine me for it? Again, the government has tried to use the "General Welfare" clause to justify such actions. I've seen anyone that has expert knowledge of the Constitution laugh at them for it. |
