I don't know this inside and out, but isn't he entitled to a private conversation with his wife (or girlfriend, or whoever it is?) Furthermore, isn't it illegal to record someone's conversation without their permission? FURTHERMORE, I'd say she did this recording deliberately to set him up for something.

Mad Mel's Racist misogynistic rant (Uncensored video inside) - EdenMaster - 10th July 2010

Whether or not it's right, the fact remains that anyone, anyone in the public eye has got to assume in today's society that whatever they do or say may become public and be prepared to be held accountable for and explain their actions, and once it's out there, it's not coming back.

Besides, past events have proven that Mel is a pretty shitty guy anyway. No surprises here.

It was his wife who apparently recorded the conversation, It was for divorce court ,She may have leaked it to the press or someone she shared it with did.

Mel Gibson has nearly destroyed himself , His talent agent has just dumped him as a client.

That being said, I would still see his movies, He is just to damn good of a actor and filmmaker to resist.

Too bad that his bad streak became so public.

Yet more reasons to dislike Mel Gibson? What, he thought we didn't have enough already? Alright then...

His wife did the recording. No, I've never heard that recording things like that is illegal. Anyway though, she said that she did it because she was afraid that he was going to get violent, and I think in the divorce filing said that he had been physically abusive, I think... which isn't exactly surprising, considering the kinds of horrible things he said in that video.

No, I think he's right. It might be that you can't use recorded phone calls as evidence in a trial if both parties aren't aware of the recording, but I'm quite certain it's frowned upon in some sense of legality.

Mad Mel's Racist misogynistic rant (Uncensored video inside) - Weltall - 10th July 2010

It's not illegal to record anyone doing or saying anything except in specific situations.

Mad Mel's Racist misogynistic rant (Uncensored video inside) - Darunia - 10th July 2010

"Specific situations," can be anything, at any time.

Mad Mel's Racist misogynistic rant (Uncensored video inside) - Weltall - 10th July 2010

No. There are certain situations which are defined as illegal for recording devices (such as while in areas of sensitive national security), or if a judge disallows recording devices in a courtroom.

But, otherwise, recording video or audio is not punishable by law.

Mad Mel's Racist misogynistic rant (Uncensored video inside) - etoven - 10th July 2010

No, I'm pretty sure Edenmasters correct. Recording audio of someone is illegal with out there knowledge and is not admissible as trail evidence. Both because it's entrapment, and also because audio recordings are to easy to forge.

Mad Mel's Racist misogynistic rant (Uncensored video inside) - Weltall - 10th July 2010

EdenMaster is correct that secret recordings are usually (but not always) inadmissible in court.

However, the act of recording, itself, is completely legal except in the circumstances mentioned previously.
